By receiving services from BEF Hosting and/or befhosting.com, you will have accepted all the terms and conditions in this agreement. BEF Hosting, the preparers of all kinds of content on this site, its employees, and persons and organizations authorized by BEF Hosting shall have no criminal or legal liability for any claims regarding material/moral damages that may arise from your failure to read these terms or your failure to comply with them even if you have read them.
BEF Hosting reserves the right to update and modify this agreement unilaterally at any time without prior notice.
All information, statistical figures, and values on the BEF Hosting Website have been compiled from sources whose reliability is accepted within general practices, and their accuracy and adequacy are in no way guaranteed by BEF Hosting. BEF Hosting has no personal, legal, or criminal liability for any direct or indirect material and/or moral, negative and/or positive damages, and possible other damages and expenses that may arise as a result of the use of the information, evaluations, comments, and statistical figures and values on the BEF Hosting website.
It is assumed and accepted by you that you have read the warnings and declarations in this agreement before receiving services from BEF Hosting. In the event of any dispute, claim, or demand in this regard, it is declared by BEF Hosting, and accepted and committed by the person(s) and organization(s) entering this BEF Hosting Website, that these expressions written on this web page and all other computer records belonging to BEF Hosting will be presented as the sole, true, and exclusive evidence.
1.) Orders and Service Delivery After the order you placed passes the fraud check and your payment is received, your account will be set up and your details will be sent to you. For payments made by credit card, other intermediary payment institutions, and PayPal, although domain name, web hosting, and reseller hosting accounts are set up automatically, the setup process may take up to 48 hours in the event of a possible problem. For payments made by wire transfer or EFT to our bank and postal check accounts, the maximum setup time is determined as 2 business days. For VDS and dedicated server services, the setup time is 48 hours unless stated otherwise. The delivery time of software and license services is a maximum of 1 week unless stated otherwise in writing/verbally. If delivery is not made within the specified time, BEF Hosting is obliged to refund your fee upon your request.
It is your responsibility to provide an active, problem-free email address that you use during the order. In case of any rule violation or when we need to reach you, the email address you provided will be used. It is your responsibility to keep your email address continuously updated and checked; all emails sent to you are considered delivered. BEF Hosting has no legal or criminal liability for any damages and losses that may occur if the emails sent to you do not reach you or are not read by you.
All information in the form you fill out during the order or while registering on our site must be accurate and complete. BEF Hosting reserves the right not to issue a refund or to issue a partial refund for orders canceled due to incorrect information. When deemed necessary for security purposes, BEF Hosting may request a photocopy/scanned image of your credit card or a photocopy/scanned image of your ID. If you do not provide these, your order may be canceled and treated as fraudulent, or the service(s) you received may be suspended. BEF Hosting reserves the right not to issue a refund or to issue a partial refund for accounts suspended due to fraud.
Site Migration For services where a site migration guarantee is given, BEF Hosting will do its best to migrate your site to BEF Hosting. However, since the site migration service is an uncertain process, BEF Hosting does not guarantee that your site will be migrated or how long it will take to migrate. Every hosting company has a different configuration, and/or some hosting companies do not have the necessary conditions to migrate a site; therefore, it can sometimes be very difficult or impossible to migrate your site correctly/completely/without errors. Your site may be migrated with errors and/or may not be migrated at all. BEF Hosting has no legal or criminal liability for any damages that may arise from this situation.
2.) Content The conditions of all services provided by BEF Hosting are regulated according to the Constitution of the Republic of Turkey.
You cannot hold BEF Hosting legally responsible by using the services provided by BEF Hosting; all legal responsibility for every action you take using the services provided to you belongs to you.
It is forbidden to violate any copyright or registration rights by using our services. This includes unauthorized music, books, photographs, or other copyrighted materials. Furthermore, as required by law, pornographic/erotic content and content that can be used for hacking cannot be hosted. Selling items in violation of copyright/registration rights and/or hosting pornographic/erotic content will result in the immediate termination of the service(s) you receive. In the event that content violating copyright/registration rights and/or content usable for hacking is encountered, this content will be deleted, or access to the content will be blocked. In case of repetition, the service may be suspended/terminated. If you believe such content is being hosted using BEF Hosting's services, you can file a complaint by sending an email to info@befhosting.com. BEF Hosting may request more information/documents from you regarding your complaint.
In complaints regarding illegal actions carried out using BEF Hosting's services, if BEF Hosting cannot verify the cause of the complaint or is unsure whether the action constitutes a crime, the service may not be terminated. BEF Hosting does not have the authority to make legal decisions. In such cases, you must legally seek your rights against the person committing this action. BEF Hosting has no legal or criminal liability for any damages and losses that may occur in such cases.
All services offered by BEF Hosting are solely for use within the limits permitted to you. If, in any way, you access content/files/services that you are not permitted to, it is your responsibility to report this to BEF Hosting without using it. Otherwise, it is your responsibility to cover all material/moral damages you may cause.
BEF Hosting may monitor site contents and/or all kinds of access for legal reasons, system administration purposes, tracking unauthorized entry, verifying security procedures, and/or operational security purposes. During monitoring, contents/information may be tested, recorded, copied, or used for the purposes described above. BEF Hosting does not use or share your contents in any way other than the purposes described above.
BEF Hosting reserves the right to provide service to anyone it wishes or to refuse service to anyone it wishes. BEF Hosting has the right to delete/block access to content on our servers that is contrary to the agreement, provocative, divisive, illegal, or deemed inappropriate, with or without warning. In such cases, BEF Hosting reserves the right not to issue a refund or to issue a partial refund.
Illegal content will be reported to the authorized authorities.
Uploading virus-infected content and content such as shell scripts that could damage BEF Hosting servers may cause your account to be completely terminated without a refund. You are obliged to cover all material/moral damages caused to BEF Hosting and/or other users through these methods. Securing your account is entirely your responsibility.
For the services you purchase from BEF Hosting, you are responsible for ensuring that the software/scripts/programs uploaded to your account are secure and that the permissions given to directories are correct. Users are responsible for every action taken on their own accounts. This responsibility includes the username and password. You must use a secure and unpredictable password for your accounts. Furthermore, you are responsible for any malicious software uploaded to our servers in any way using your account. Where necessary, BEF Hosting reserves the right to terminate your services without a refund or by issuing a partial refund. BEF Hosting will not accept any legal or criminal liability for material/moral damages that may arise in this regard. You are obliged to cover all material/moral damages caused to BEF Hosting and/or other users using your account.
BEF Hosting reserves the right to request you to modify any website, database, account, or any other material/service.
3.) SPAM Prohibition BEF Hosting has zero tolerance for unsolicited email delivery, bulk email delivery, and spam emails. If you do not comply with this, the service(s) you receive will be terminated with/without notice. All services that cause our IP block to be blacklisted will be terminated without notice.
If BEF Hosting's IP block enters email blacklists, BEF Hosting reserves the right to demand the necessary fee from the person who caused this to rectify the situation. This fee is independent of BEF Hosting and will be used to clear the IP block from email blacklists. By receiving service from us, you agree that in such cases, you will pay the necessary fee without objection within the requested period.
4.) Payment As long as you receive service from BEF Hosting, you agree to pay BEF Hosting the cost of the service you receive. Unless you cancel the service you receive, the service will continue to be renewed, and an invoice will be generated for the service you will receive. If you do not want to continue receiving the service, you must state that you want to cancel it at least 15 days in advance; thus, depending on your request, your service will be canceled at the end of the day or after the period for which you have paid.
Service cancellation must be done from your customer panel. The cancellation page contains the necessary options to cancel the service immediately or when its term expires.
For accounts whose payment is not made if not canceled 15 days in advance, BEF Hosting reserves the right to collect the fee through legal means.
As long as you receive service from BEF Hosting, it is your responsibility to ensure that your payment information is up-to-date and to pay your invoices on time. If the invoice is not paid on time, BEF Hosting will give an additional 6 days for web hosting and reseller hosting accounts for the invoice to be paid, and at the end of this period, your service will be suspended. 30 days after the due date, the service you receive will be terminated. For domain name, VDS, and dedicated server services, if payment is not made on the due date, your accounts will be terminated immediately. BEF Hosting cannot be held responsible in any way for material/moral damages and data losses that may arise in this regard.
Overpayments made accidentally and/or intentionally are added to your account as credit, and no refunds will be made for any reason. You can use this added credit for future services you will purchase from BEF Hosting.
BEF Hosting reserves the right to change the prices of its products at any time without notice.
If the disk space, traffic, and similar resources you purchased are used more than the purchased amount, BEF Hosting will demand the cost of the used resources from you. In such a case, it is your responsibility to pay the necessary fee without objection within the requested period. If not paid, your account will be terminated without a refund, and BEF Hosting will not be responsible for material/moral damages and data losses that may occur in this regard.
In cases of chargebacks, disputes, etc., made using payment channels without the knowledge and/or permission of BEF Hosting, it is your responsibility to cover all material and moral damages caused to BEF Hosting.
5.) Backup and Data Loss While using our services, the responsibility for all your data belongs to you. BEF Hosting offers the backup service as a convenience to you and absolutely does not give any guarantees regarding backups. BEF Hosting cannot be held strictly responsible for any data losses you may experience for any reason.
6.) Service Cancellation and Refund BEF Hosting reserves the right to terminate any service at any time, with or without notice, without a refund or by making a partial refund, without showing a reason.
Insulting/exhibiting rude behavior towards any of our employees will cause your account/the service(s) you receive to be suspended/terminated. In such a case, your membership will be terminated without any refund, and the agreement will be annulled.
If you receive service from BEF Hosting, you undertake to refrain from all actions such as comments, behavior, advertisements, posters, articles, and words that damage commercial reputation against BEF Hosting or its employees. In the event of contrary behavior, you accept that you are under an obligation to pay material-moral compensation, and in all lawsuits to be filed in this case, the Courts and Enforcement Offices of Yozgat are authorized.
Attacked sites that indirectly or directly damage our servers and/or cause problems such as slowdowns/interruptions can be terminated without notice and without a refund. In such cases, BEF Hosting may request you to cover the resulting damage. In such a case, it is your responsibility to pay the necessary fee without objection within the requested period.
For paid services, if the service is canceled before the service period expires (due to usage contrary to the service agreement, user request, etc.), a full refund of the service fee or a refund of the unused period's fee will not be made. You can use the credit in your account for services you can purchase from us, but no refunds will be made, nor will credit be added to your account for services that are terminated early.
7a.) Use of Service
7aa.) Web Hosting/Reseller Hosting
Unauthorized actions: a) It is strictly forbidden to send bulk emails and SPAM emails for any reason and in any way. Email services are offered for your use solely for your normal correspondence. b) Resource usage over 25% for more than 90 seconds is forbidden. There are many activities that can cause this issue, including CGI software, FTP, PHP, HTTP, etc. Resource usage reports are determined by BEF Hosting, and BEF Hosting is not obliged to provide any proof of your resource usage. c) It is forbidden to use more than 5% daily average resources for web hosting accounts and more than 12% daily average resources for reseller hosting accounts. There are many activities that can cause this issue, including CGI software, FTP, PHP, HTTP, etc. Resource usage reports are determined by BEF Hosting, and BEF Hosting is not obliged to provide any proof regarding your resource usage. d) Running any server-based program on our servers is forbidden. This includes server-based programs like IRCD. e) Running spider or indexer programs like Google Cash/AdSpy is forbidden. f) Running any software that communicates with IRC (Internet Relay Chat) networks is forbidden. g) Running any proxy application is forbidden. h) Running any bit torrent application is forbidden. You can link to legal torrents outside our servers, but you cannot host them on our servers. i) Any file-sharing/peer-to-peer applications cannot be run. j) Game server applications such as Counter-Strike, Half-Life, etc., are forbidden. k) Running cronjob applications at intervals of less than 15 minutes is forbidden. l) Running file-sharing software is forbidden (e.g., rapidshare, etc.). m) Running audio stream/video broadcast applications is forbidden. n) Each web hosting account is limited to hold a maximum of 250,000 files. Accounts with more than 100,000 files are not backed up by us.
7ab.) VDS/Dedicated Server
Unauthorized actions: a) It is strictly forbidden to send bulk emails and SPAM emails for any reason and in any way. Email services are offered for your use solely for your normal correspondence. b) In VDS services, intense resource usage that would harm other VDSs in any way cannot be carried out. Intensive disk activities usually cause this problem. c) Running any proxy application is forbidden. d) Running any bit torrent application is forbidden. You can link to legal torrents outside our servers, but you cannot host them on our servers. e) Any file-sharing/peer-to-peer applications cannot be run. f) Game server applications such as Knight Online, Counter-Strike, Half-Life, etc., are forbidden.
7b.) Backup Limit The service(s) received by customers who constantly perform backups that BEF Hosting considers unnecessary may be suspended/terminated with/without notice. This clause is valid if the server is damaged by using the backup service for purposes other than backing up.
7c.) Unlimited Web Hosting a) Unlimited web hosting services cover only the hosting of your website files and only your website traffic. There is a limit of 150,000 Inodes for all packages. b) Unlimited web hosting space cannot be used for data storage and/or backup purposes.
8.) Traffic Usage Depending on the package you purchase, you will have a certain traffic limit. If this limit is filled/exceeded, the purchased service(s) may be automatically suspended until the next month or until more traffic is purchased. Tracking the used traffic is up to you. Unused traffic cannot be transferred to the next month. Usage exceeding the purchased traffic will be invoiced the following month, and you agree to pay this fee without objection within the requested period.
9.) Uptime Guarantee If the 99% uptime guarantee provided by BEF Hosting is not fulfilled, BEF Hosting is responsible for providing one month of free use for the relevant service upon your request. Uptime reports reported by third-party monitoring software are not valid for BEF Hosting; BEF Hosting keeps and publishes the uptime reports itself. In cases where the uptime guarantee is not fulfilled, you must send an email to info@befhosting.com to have credit added to your account. In VDS and dedicated server services, a guarantee is given only for the network; whether your VDS or dedicated server is running and/or accessible is not BEF Hosting's responsibility. In such cases, unless you report it, BEF Hosting will not be aware of the problem. The discount to be provided in VDS/Dedicated server services when the uptime guarantee cannot be met does not cover 3rd Party software/license fees.
The uptime guarantee is not valid during attacks by malicious persons aiming to keep the server down and during previously announced server maintenance. Therefore, the resulting downtime will not be reflected in the uptime rate in interruptions occurring for these reasons.
10a.) Scope of Support You agree that BEF Hosting will not provide any support on issues not covered by the service you receive. BEF Hosting has no obligation to provide software support and perform user operations (creating an email account/setting up email, creating a database, etc.) for any hosting service received. In VDS/dedicated server services, support is only provided for restoring the system to its initially delivered state; additional software installations and user operations do not fall within the scope of support. In software services, BEF Hosting is only obliged to deliver smoothly working software.
To benefit from the support system, you must log in to your customer panel with your password and send a support ticket from your Support Tickets section. Through other channels (email, phone, live support, contact form, etc.), no information regarding the account is shared, and no transactions are made.
10b.) 24/7 Support and Support Response Time The concept of 24/7 support does not mean that you will reach us every time you call by phone/receive an instant reply to your support tickets. Our support team tries to respond to your tickets as fast as possible. 24/7 support indicates that work is done without depending on business hours, and the response you will receive to your support ticket depending on the workload of the support team is a maximum of 24 hours unless exceptional situations occur.
11.) Reseller Hosting: Customer Responsibility If you purchase a reseller hosting account, you are responsible for providing support to your own customers. BEF Hosting will not provide support to the customers of reseller hosting users. If any customer of our reseller hosting user contacts us, BEF Hosting reserves the right to suspend your account until you deal with your own customer. Furthermore, our reseller hosting users are responsible for the content of their own customers' sites. BEF Hosting cannot be held responsible in any way for the illegal behaviors and behaviors contrary to the agreement of the reseller hosting users' customers.
12.) VDS and Dedicated Server BEF Hosting reserves the right to reset the password of any VDS or dedicated server service it offers. Keeping a valid email address and root password registered in our system is the customer's responsibility. VDS and dedicated servers are not backed up by us; all data and the backing up of data are the customer's responsibility.
13.) Co-Location (Server Hosting) BEF Hosting reserves the right to reset the password of the server in any server hosting service it offers. Keeping a valid email address and root password registered in our system is the customer's responsibility. The person receiving the hosting service is not backed up by us; all data and the backing up of data are the customer's responsibility. In payment delays that occur in server hosting services, BEF Hosting reserves the right to hold the hosted server and other equipment as collateral until the payment is made along with legal interest.
14.) Price Change For the service you purchased, no additional fee will be demanded from you during the service period you purchased, unless you purchase an additional feature or unless you use it outside the limits permitted to you. BEF Hosting reserves the right to change prices and renew the service with new pricing at the end of the service period.
15a.) Indemnification By receiving service from BEF Hosting, you accept that you will not cause any harm to BEF Hosting in any way, that you will not cause any material/moral damage, and you commit to covering any material/moral damage caused.
15b.) Legal Obligations By receiving service from BEF Hosting, you accept not to impose any legal obligation on BEF Hosting. In such a case, you commit to covering all court and attorney fees within the requested period.
16.) Waiver/Disclaimer BEF Hosting cannot be held responsible for any damage your business may suffer. BEF Hosting offers no guarantees regarding the service(s) it provides. This includes data losses, delays, interruptions, and erroneous information delivery caused by BEF Hosting and any BEF Hosting official. BEF Hosting will not accept responsibility if your data/information is obtained by third parties during a possible hacking event.
17.) Providing Legal Information BEF Hosting is obliged to provide any requested information to legal authorities when necessary. This information may also include your private information when necessary.
